Terms of Service

Welcome to Phantoma.ai ("Phantoma," "we," "us," or "our"). By accessing or using our website, applications, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

1. Definitions

• "User" means any individual who creates an account or uses the Services.
• "Content" means any text, scripts, images, thumbnails, videos, or other materials created by or through the Services.
• "Output" means AI-generated content produced by the Services, including scripts, thumbnails, and videos.
• "Project" means a user-created workspace within the Services containing topics, settings, and generated Content.
• "Subscription" means a recurring paid plan granting access to the Services.
• "Acceptable Use Policy" or "AUP" means the policy located at phantoma.ai/acceptable-use, which is incorporated into these Terms by reference.
• "AI Voice"means a synthetic, computer-generated voice selected from our library of generic voice options. Phantoma does not offer voice cloning or replication of any real person's voice.
• "Stock Media" means licensed visual assets (images, video clips) sourced from third-party stock libraries and used in generated Content.

2. Eligibility

You must be at least 16 years of age to use the Services. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. Description of Services

Phantoma.ai is an AI-powered platform for generating faceless video content. The Services include AI-driven topic research, script generation, thumbnail creation, and video production. Features and availability may change at our discretion.

All voices available within the Services are generic, pre-built synthetic voices provided by our third-party AI partners. We do not offer, and the Services do not support, voice cloning, voice replication of real individuals, or the use of any person's likeness without authorization. Visual content is composed of AI-generated imagery and licensed stock media - the Services do not generate depictions of identifiable real people.

5. Subscriptions and Payment

• Subscriptions are billed on a recurring basis (monthly or annually) and renew automatically unless cancelled before the renewal date.
• All payments are processed by our designated payment processor, which acts as the Merchant of Record for all transactions. By purchasing a Subscription, you also agree to the payment processor's applicable terms of service.
• Subscription fees are generally non-refundable for the current billing period. You may cancel at any time; your access will continue until the end of the paid period.
• We reserve the right to change pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle.
• Free-tier usage is limited and subject to the quotas described on our pricing page.

6. Refund Policy

• All payments are processed by our designated payment processor, which acts as the Merchant of Record for all transactions.
• You may request a refund within 14 days of your initial Subscription purchase if you have not generated any video content using the Services during that period.
• Renewal charges (monthly or annual) are non-refundable once the new billing period has begun. You may cancel your Subscription at any time to prevent future charges; your access will continue until the end of the current paid period.
• If you experience a technical issue that prevents you from using the Services and we are unable to resolve it within a reasonable timeframe, you may be eligible for a pro-rated refund at our discretion.
• To request a refund, contact us at support@phantoma.ai with your account email and a description of the issue. We aim to respond to all refund requests within 5 business days.

7. Content Ownership and License

Your Content

You retain ownership of any original content you provide to the Services (e.g., topics, custom instructions). You grant Phantoma a limited, non-exclusive, worldwide license to use this content solely to provide and improve the Services.

AI-Generated Output

Subject to your compliance with these Terms and an active Subscription (where applicable), you own the Output generated through your use of the Services. You may use Output for personal and commercial purposes.

We do not guarantee that Output is unique, original, or free from similarity to other content. AI-generated works may not qualify for copyright protection in all jurisdictions. You are solely responsible for evaluating and using Output.

You are solely responsible for reviewing all Output before publishing or distributing it. You must ensure that Output does not violate any applicable laws, third-party rights, or platform policies. You acknowledge that AI-generated content may require human review for factual accuracy, appropriateness, and compliance with the disclosure requirements of the platforms where you publish it.

Our Data Practices

We do not use your Content, prompts, or Output to train, fine-tune, or improve any machine learning or AI models. We may use anonymized, aggregated usage metadata (such as feature usage frequency and error rates) for product improvement and analytics.

8. Acceptable Use

Your use of the Services is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference.

Without limiting the AUP, the following are expressly prohibited:

• Illegal content or content that facilitates illegal activity
• Sexually explicit, pornographic, or obscene material
• Content that promotes violence, hatred, harassment, or discrimination
• Misinformation, disinformation, or deceptive content designed to mislead
• Content targeting, exploiting, or endangering minors
• Content that infringes on the intellectual property rights of others
• Spam, phishing, or unauthorized commercial solicitations
• Content that impersonates real individuals without their consent
• Content designed to manipulate elections or political processes
• Malware, exploits, or content intended to harm computer systems
• Attempting to use the Services to clone, replicate, or simulate the voice of any real person
• Creating content that constitutes a deepfake or non-consensual synthetic depiction of any identifiable individual
• Generating content intended to deceive viewers into believing it was created by a human without AI involvement, where such disclosure is required by applicable law or platform policy
• Circumventing or attempting to circumvent any content filtering or safety features of the Services

We employ automated content filtering on inputs and may review Output for policy compliance. We reserve the right to suspend or terminate accounts, remove Content, and report illegal activity to law enforcement, at our sole discretion and without prior notice.

9. Connected Social Accounts

The Services allow you to connect third-party social accounts (such as YouTube via Google OAuth, TikTok via TikTok Login Kit, and Instagram via the Instagram API with Instagram Login) to publish videos directly from Phantoma. By connecting an account, you:

• Authorise Phantoma to upload videos to that account solely when you explicitly initiate an upload from within the Services.
• Grant Phantoma permission to store the OAuth tokens and basic account identifiers required to perform those uploads, as described in our Privacy Policy.
• Agree to comply with the terms, policies, and content guidelines of the connected platform, including the YouTube Terms of Service and the Google Privacy Policy for YouTube connections, and the TikTok Terms of Service, TikTok Community Guidelines, and TikTok Privacy Policy for TikTok connections, and the Instagram Terms of Use, Instagram Community Guidelines, and Instagram Privacy Policy for Instagram connections.

For TikTok connections specifically, Phantoma publishes videos directly to your TikTok account using the Direct Post feature of TikTok's Content Posting API. Each time you open the TikTok publish form, Phantoma fetches your current TikTok creator information (display name, avatar, allowed privacy levels, maximum video duration, and which interaction options are available) so the form reflects your account's up-to-date state, shows a preview of the video, and reminds you that posts may take a few minutes to appear on your TikTok profile after publishing. When you click publish, Phantoma sends the video together with the caption, privacy setting, comment/duet/stitch toggles, commercial-content disclosure (whether the video promotes your own brand and/or is paid branded content), and the AI-generated content (AIGC) label that you selected. You are solely responsible for the content of every post and for the accuracy of any commercial-content disclosure you make. By publishing, you also agree to TikTok's Music Usage Confirmation, and where applicable TikTok's Branded Content Policy, both of which are linked in the publish form. TikTok refresh tokens expire after 365 days, so you may be asked to reconnect your TikTok account approximately once per year.

For Instagram connections specifically, Phantoma publishes Reels directly to your Instagram Professional (Business or Creator) account using Meta's Instagram Graph API. Personal Instagram accounts are not eligible for API publishing. When you click publish, Phantoma sends Instagram the URL of the rendered video together with the caption you selected; Instagram fetches the video from our storage and creates a Reel on your account. You are solely responsible for the content of every post. Instagram access tokens are valid for approximately 60 days, so you may be asked to reconnect your Instagram account periodically.

You may revoke Phantoma's access to any connected account at any time by disconnecting it from your Account page in Phantoma, or directly with the connected provider:

• For Google-based connections (YouTube): https://myaccount.google.com/permissions
• For TikTok connections: in the TikTok mobile app, go to Profile → Settings and privacy → Security & permissions → Apps with access (label may vary by app version), then remove Phantoma. TikTok currently manages connected-app permissions through its mobile app rather than the web settings.
• For Instagram connections: in the Instagram app, go to Profile → Settings and privacy → Apps and websites → Active, select Phantoma, then remove access.

Revocation takes effect immediately; videos you have already published remain on the connected platform under your control.

Phantoma's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

10. AI Transparency and Disclosure

All content produced through the Services is generated using artificial intelligence. You acknowledge and agree that:

• You will clearly disclose that content was AI-generated when publishing on platforms that require such disclosure, including but not limited to YouTube, TikTok, and Instagram, each of which has AI content labeling policies. For TikTok, Phantoma marks uploads with the required AI-generated content (AIGC) label where applicable; AI-generated content is currently excluded from TikTok's Creator Rewards / Creativity Program.
• You will not represent AI-generated content as human-created where doing so would be misleading or deceptive.
• You are responsible for complying with all applicable AI transparency laws, including the EU AI Act (effective August 2026) and applicable US state laws regarding synthetic media.
• Phantoma may add metadata or watermarks to Output to indicate AI generation, in compliance with applicable regulations.

11. Content Moderation

We maintain content moderation practices to promote the safe and responsible use of the Services:

• Input filtering: User prompts and topics are screened against our content policies before processing.
• Output review: We reserve the right to review generated Content for compliance with these Terms and the Acceptable Use Policy.
• Reporting: Users may report Content that violates our policies by contacting support@phantoma.ai.
• Enforcement: Violations may result in content removal, account suspension, or permanent termination, depending on severity. Repeated or egregious violations will result in immediate termination without notice.
• Appeals: Users may appeal enforcement actions by contacting support@phantoma.ai within 14 days of the action.

12. Intellectual Property

All rights, title, and interest in the Services, including but not limited to software, design, logos, and documentation, are owned by Phantoma or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written permission.

13. Third-Party Services

The Services integrate with third-party providers for video generation, image generation, and payment processing. These third-party services are not operated by us, and we are not responsible for their availability, performance, accuracy, or data handling practices. Your use of third-party services is subject to their respective terms and policies.

Our AI processing partners (including fal.ai for image generation and our language-model providers) process your Content solely to provide the Services. These partners are contractually prohibited from using your Content to train their own models. Video rendering itself runs on our own AWS infrastructure. For details on how each provider handles data, refer to their respective privacy policies.

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Services will be uninterrupted or error-free; (b) AI-generated Output will be accurate, complete, or free from bias; (c) Output will be suitable for any particular purpose; or (d) defects will be corrected.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHANTOMA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to indemnify, defend, and hold harmless Phantoma and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms or the Acceptable Use Policy; (c) your Content or Output; (d) your violation of any third-party rights; or (e) your failure to comply with applicable AI transparency or disclosure laws.

17. Termination

• You may terminate your account at any time by contacting us or deleting your account through the Services.
• We may suspend or terminate your access for material breach of these Terms or the Acceptable Use Policy. Where the breach is curable, we will provide 14 days' notice to remedy it. We may terminate immediately for illegal use or egregious violations.
• Upon termination, your right to use the Services ceases immediately. Pre-paid fees are non-refundable. We may delete your Content and data after a reasonable period following termination.
• Sections relating to ownership, liability, indemnification, and disputes survive termination.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the competent courts in Tel Aviv, Israel.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
